ข้อกำหนดและเงื่อนไข

1. บทนำ

เงื่อนไขและข้อตกลงนี้ทำขึ้นเพื่อใข้กับการซื้อสินค้าจากเว็บไซต์ www.iamquinn.com ที่ดำเนินการโดย บริษัท ยัสปาล จำกัด (มหาชน) และบริษัทในเครือ ซึ่งตกลงให้บริการกับคุณ (ต่อไปนี้จะเรียกว่า “เว็บไซต์” ภายใต้เงื่อนไขเหล่านี้ กรุณาอ่านข้อตกลงต่อไปนี้อย่างละเอียด หากคุณไม่ยอมรับข้อตกลงและเงื่อนไขเหล่านี้ กรุณาหลีกเลี่ยงหรืองดใช้งานเว็บไซต์ การที่คุณเข้าใช้เว็บไซต์นี้หรือเข้าไปดูข้อมูลในหน้าใดๆของเว็บไซต์นี้ ถือเป็นการยอมรับข้อผูกพันทางกฎหมายที่ระบุไว้ในข้อตกลงและเงื่อนไขการใช้บริการนี้ โดยรวมถึงนโยบายความเป็นส่วนตัวที่กำหนดการใช้งานบริษัท Jaspal จำกัดและผู้ใช้งานเว็บไซต์

1. ข้อมูลต่างๆ บนเว็บไซต์และคำอธิบายสินค้า

ถึงแม้ว่า เราจะพยายามทุกวิถีทางที่จะทำให้ข้อมูลต่างๆ ในเว็บไซต์ของเราอัพเดทมากที่สุด แต่ทางบริษัท ยัสปาล จำกัด (มหาชน) หรือบุคคลที่สาม หรือผู้ให้บริการทำเนื้อหาก็ไม่สามารถแสดงให้เห็นหรือรับประกัน ไม่ว่าจะเป็นการแสดงออก บอกเป็นนัยยะทางกฎหมาย ถึงลำดับ ความถูกต้อง ความสมบูรณ์ หรือความน่าเชื่อถือของข้อมูล ความคิดเห็น ข้อมูลราคา ข้อมูลจากการค้นคว้า ข้อมูลและ/ หรือเนื้อหาที่อยู๋ในเว็บไซต์ (รวมถึงแต่ไม่จำกัดเพียงแต่ ข้อมูลใดๆ ที่อาจจัดทำโดยบุคคลที่สาม หรือผู้ให้บริการเนื้อหา) และจะไม่มีผลผูกมัดใดๆ จากข้อมูลใดๆ ก็ตามที่อยู่บนเว็บไซต์

บริษัท ยัสปาล จำกัด (มหาชน) ขอสงวนสิทธิ์ที่จะทำการแก้ไขเปลี่ยนแปลงส่วนหนึ่งส่วนใดของเว็บไซต์หรือยุติการให้บริการได้โดยไม่ต้องแจ้งล่วงหน้า ข้อมูลและองค์ประกอบใดๆ บนเว็บไซต์นี้ มีวัตถุประสงค์เพื่อให้ข้อมูลแก่ผู้บริโภคทั่วไปเท่านั้น ไม่มีข้อมูลส่วนหนึ่งส่วนใดที่มีวัตถุประสงค์เพื่อเป็นการให้คำแนะนำ และถึงมิได้มีวัตถุประสงค์เพื่อการค้าแต่อย่างใด คุณและบริษัทใช้ข้อมูลบนเว็บไซต์ของเราด้วยความเสี่ยงของตัวคุณเอง หากคุณพบข้อผิดพลาดหรือการขาดตกของข้อมูลบนเว็บไซต์ของเรา กรุณาแจ้งให้เราทราบ

1. เครื่องหมายการค้าและลิขสิทธิ์

บริษัท ยัสปาล จำกัด (มหาชน เจ้าของลิขสิทธิ์ เครื่องหมายการค้า ชื่อ สัญลักษณ์และสัญลักษณ์การให้บริการส่วนประกอบอื่นๆ ที่ปรากฏบนเว็บไซต์นี้ (รวมเรียกว่า "เครื่องหมายการค้า") ทั้งที่จดทะเบียนและไม่ได้จดทะเบียน เนื้อหาบนเว็บไซต์นี้ไม่นับเป็นการอนุญาตหรือให้สิทธิ์ในการใช้เครื่องหมายการค้าโดยมิได้รับความยินยอมเป็นลายลักษณ์อักษรจาก บริษัท ยัสปาล จำกัด (มหาชน)

1. ลิงค์ไปยังเว็บไซต์อื่น

เว็บไซต์ของ บริษัท ยัสปาล จำกัด (มหาชน) อาจมีการเชื่อมโยงกับเว็บไซต์อื่น เพื่ออำนวยความสะดวกให้กับผู้ใช้ แต่ทั้งนี้ทั้งนั้นลิงค์เหล่านี้อยู่นอกเหนือการควบคุมของ iamquinn.com และไม่ได้เป็นการรับรองเนื้อหาใดๆ บนเว็บไซต์เหล่านั้น การเข้าเยี่ยมชมหรือใช้ข้อมูลลิงค์ที่เชื่อมต่อกับเว็บไซต์อื่นๆ นั้นถือเป็นความเสี่ยงของคุณ เมื่อคุณเข้าเยี่ยมชมเว็บไซต์อื่นๆ คุณควรอ่านรายละเอียดข้อตกลงและเงื่อนไขการใช้บริการของเว็บไซต์ที่เชื่อมโยงนั้นก่อนเข้าใช้เว็บเหล่านั้น เราไม่อนุญาตให้คุณทำลิงค์จากเว็บไซต์ของตนเองเพื่อเชื่อมโยงไปยังเว็บไซต์เหล่านั้นโดยมิได้มีการขออนุญาตจาก บริษัท ยัสปาล จำกัด (มหาชน) เป็นลายลักษณ์อักษรเสียก่อน หากคุณต้องการทำลิงค์เชื่อมโยงไปยังเว็บไซต์ของคุณ กรุณาติดต่อเราโดยตรง

1. การอภิปรายสาธารณะและการส่งข้อมูลของผู้ใช้

บริษัท ยัสปาล จำกัด (มหาชน) ไม่หน้าที่รับผิดชอบต่อเนื้อหาใดๆ ที่คุณได้ทำการนำเสนอในพื้นที่สาธารธะ (ทั้งนี้รวมถึงเว็บบอร์ด ทุกหน้าของเว็บไซต์ ห้องแชท หรือพื้นที่สาธารณะใดๆ ก็ตามที่ปรากฏอยู่ในเว็บไซต์) เนื้อหาใดๆ (ไม่ว่าจะส่งมาจากคุณหรือผู้ใช้คนอื่นๆ) ไม่ได้รับการสนับสนุน ตรวจสอบ หรืออนุมัติจากเรา บริษัท ยัสปาล จำกัด (มหาชน) ขอสงวนสิทธิ์ในการตัดสินแต่เพียงผู้เดียวในการลบเนื้อหาที่คุณส่งหรือโพสต์ไว้โดยไม่ต้องแจ้งให้ทราบล่วงหน้า หากเราเห็นว่าหรือตัดสินว่ามีความเป็นไปได้ที่คุณอาจจะ มีเจตนาที่รวมถึงแต่ไม่จำกัดเพียงเจตนาดังต่อไปนี้

5.1 ข้อความหรือเนื้อหาอันเป็นการทำลายชื่อเสียง หมิ่นประมาท ส่อเสียด คุกคาม ว่ากล่าวให้ร้าย หรือละเมิดสิทธิของผู้ใช้ท่านอื่นหรือบุคคลที่ 3

5.2 การนำเสนอ เผยแพร่ ข้อมูลหรือเนื้อหาที่เป็นการนำเสนอที่ให้ร้าย ลามก อนาจารหรือขัดต่อกฎหมายใดๆ

5.3 การเผยแพร่หรืออัพโหลดไฟล์ข้อมูลที่มีไวรัส ไฟล์ที่ส่งผลให้เกิดการทำงานที่ไม่ปกติ หรือ ซอฟท์แวร์ หรือโปรแกรมใดๆ ที่อาจก่อให้เกิดความเสียหายต่อการดำเนินงานของ บริษัท ยัสปาล จำกัด (มหาชน) และ/หรือระบบคอมพิวเตอร์ รวมถึงระบบเครือข่ายของบุคคลที่สาม

5.4 ข้อความหรือเนื้อหาที่เป็นการละเมิดลิขสิทธิ์ เครื่องหมายการค้า ที่เป็นการละเมิดกฎหมายของประเทศไทยหรือ นานาชาติ รวมถึงการละเมิดลิขสิทธิ์ทรัพย์สินทางปัญญาของบริษัท ยัสปาล จำกัด (มหาชน) หรือบุคคลที่สาม

5.5 การนำเสนอข้อความหรือเนื้อหาที่เป็นการทำการตลาดหรือการสนับสนุนการขายซึ่งมีเจตนาเพื่อเป็นการชักจูงทางธุรกิจ

1. สมาชิกภาพ

เว็บไซต์ของบริษัท ยัสปาล จำกัด (มหาชน) ไม่ให้บริการกับผู้ใช้งานที่มีอายุต่ำกว่า 18 ปี ซึ่งเป็นผู้ที่อยู่นอกเหนือจากกลุ่มเป้าหมายของเรา หรือสมาชิกที่เคยถูกบริษัท ยัสปาล จำกัด (มหาชน) ตัดสิทธิ์การใช้งานไปแล้ว ผู้ใช้งานแต่ละท่านจะได้รับอนุญาตให้มีบัญชีผู้ใช้งานได้เพียงบัญชีเดียวเท่านั้น การละเมิดเงื่อนไขที่ได้กล่าวมาแล้วนั้นอาจส่งผลให้เกิดการระงับบัญชีผู้ใช้งานได้

บริษัท ยัสปาล จำกัด (มหาชน) อาจมีการนำเสนอโปรโมชั่นเป็นครั้งคราว และจากโปรโมชั่นพิเศษเหล่านี้หากสมาชิกผู้ใช้งานท่านใดที่ได้รับรางวัล (จะเป็นของรางวัล เครดิตพิเศษ บัตรของขวัญ คูปอง หรือ ผลประโยชน์อื่นใด) จากบริษัท ยัสปาล จำกัด (มหาชน) แต่มีการสมัครสมาชิกไว้หลายบัญชี หรือใช้อีเมลหลายชื่อ รวมถึงการให้ข้อมูลที่เป็นเท็จหรือมีการกระทำอันเป็นการหลอกลวงจะถูกตัดสิทธิ์ในการได้รับรางวัลใดๆ จากกิจกรรมที่ทางเราจัดทำขึ้น และอาจจะถูกดำเนินคดีแพ่งหรืออาญาตามที่กฎหมายบัญญัติไว้

การใช้งานเว็บไซต์ของ บริษัท ยัสปาล จำกัด (มหาชน) พึงตระหนักว่าคุณต้องมีอายุครบตามที่กฎหมายกำหนดในการทำสัญญากับเราและต้องมิใช่บุคคลที่เคยถูกระงับการให้บริการตามกฎหมายของประเทศไทยหรือขอบเขตกฎหมายอื่นใด และหากบริษัท ยัสปาล จำกัด (มหาชน) ส่งคำร้องขอไป คุณยินยอมที่จะให้ข้อมูลของตนเองตามความจริงและความถูกต้อง หาคุณให้ข้อมูลอันเป็นเท็จ ไม่ถูกต้อง หรือไม่ครบถ้วนสมบูรณ์ บริษัท ยัสปาล จำกัด (มหาชน) มีสิทธิ์ที่จะระงับสิทธิ์ในการเป็นสมาชิกชั่วคราว หรือยกเลิกการเป็นสมาชิกของคุณ และปฏิเสธการรับเป็นสมาชิกเพื่อใช้งานในอนาคต คุณจะต้องเป็นผู้รับผิดชอบแต่ผู้เดียวในการเก็บรักษาชื่อบัญชีผู้ใช้งานและรหัสผ่านของตนเองให้เป็นความลับ คุณตกลงยินยอมที่จะรับผิดชอบต่อการกระทำใดๆ ที่เกิดขึ้นภายใต้ชื่อบัญชีผู้ใช้งานของคุณ

1. การยกเลิกอันเกิดจากความผิดพลาด

บริษัท ยัสปาล จำกัด (มหาชน) มีสิทธิทุกประการในการยกเลิกคำสั่งซื้อได้ทุกเมื่อ หากความผิดพลาดนั้นเกิดมาจากความผิดพลาดในการพิมพ์หรือความผิดพลาดที่มิได้มีการคาดการณ์ไว้ล่วงหน้า ที่เป็นผลให้เกิดความผิดพลาดในการลงสินค้าในเว็บไซต์ (ไม่ว่าจะเป็นการลงราคาผิด การลงรายละเอียดที่ผิด ฯลฯ) ในกรณีที่รายการสั่งซื้อนั้นถูกยกเลิกและคุณได้ชำระเงินไปเรียบร้อยแล้ว บริษัท ยัสปาล จำกัด (มหาชน) จะทำการคืนเงินให้ท่านเต็มจำนวนราคาสินค้าดังกล่าว

1. การใช้งานอันไม่เหมาะสม

คุณตกลงใจที่จะไม่ใช้เว็บไซต์ของ บริษัท ยัสปาล จำกัด (มหาชน) ในการส่งหรือโพสต์เนื้อหาหรือข้อความใดๆ ที่เป็นการขัดต่อกฎหมาย ข่มขู่ รังควาน เจตนาทำลายชื่อเสียง หมิ่นประมาท หยาบคาย คุกคาม มุ่งร้าย ลามกอนาจาร ส่อไปในทางเรื่องเพศ เป็นการเหยียดเชื้อชาติ ก้าวร้าว ทำให้ผู้อื่นไม่พอใจ ดูหมิ่นศาสนา ภาพลามกอนาจาร หรือการละเมิดกฎหมายใดๆ หากคุณได้ทำการส่งหรือประกาศถึงเนื้อหา หรือ ข้อความ รวมถึง รูปภาพใดๆที่กล่าวมาแล้วนั้น และทาง บริษัท ยัสปาล จำกัด (มหาชน) หรือ บุคคลที่สามใดๆก็ตาม ได้รับความเสียหายอันเนื่องมาจากเนื้อหาหรือข้อมูลของคุณ ไม่ว่าจะทางตรงหรือทางอ้อมก็ตามที คุณจะต้องเป็นผู้รับผิดชอบความเสียหาย รวมถึงหนี้สิน ค่าเสียหายและรายจ่ายอันเกิดขึ้นที่ บริษัท ยัสปาล จำกัด (มหาชน) หรือ บุคคลที่ 3 ต้องสูญเสียไป

1. การรับประกัน

ไม่ว่าในกรณีใดๆ บริษัท ยัสปาล จำกัด (มหาชน) ไม่ขอรับประกัน รับรอง (ไม่ว่าจะแสดงออกอย่างชัดเจนหรือบอกเป็นนัยยะทางกฎหมายก็ตามที) เว็บไซต์ เนื้อหาเว็บไซต์ ข้อมูลส่วนตัวของคุณและบริษัท หรือสื่อหรือข้อมูลที่ส่งผ่านระบบของเรา

1. ข้อความปฏิเสธความรับผิดชอบ

บริษัท ยัสปาล จำกัด (มหาชน) ขอปฏิเสธละไม่รับผิดชอบในความเสียหายใดๆ รวมถึงความเสียหาย สูญเสียและค่าใช้จ่ายที่เกิดขึ้น (ไม่ว่าทางตรง ทางอ้อม หรือเป็นผลจาก)การบาดเจ็บทางร่างกาย หรือค่าใช้จ่ายอันเกิดขึ้นจากเหตุผลใดก็ตาม ซึ่งอาจทำให้คุณหรือบุคคลที่สาม (รวมถึงบริษัทของคุณ) รวมทั้งผลลัพธ์อาจเกิดจากการเข้าถึงและงานในเว็บไซต์ ข้อมูลใดๆ ที่ปรากฏอยู่บนเว็บไซต์ ข้อมูลส่วนตัวของคุณหรือข้อมูลบริษัทคุณ ตลอดจนเนื้อหาและข้อมูลต่างๆที่มีการส่งผ่านระบบของเรา กล่าวให้เฉพาะเจาะจงลงไปคือ ทั้งบริษัท ยัสปาล จำกัด (มหาชน) หรือบุคคลที่สามใดๆ หรือข้อมูล หรือผู้ให้บริการเนื้อหาไม่ต้องรับผิดชอบใดๆ ทางกฎหมายต่อคุณหรือต่อบุคคลอื่นใด ต่อบริษัทหรือองค์กรใดก็ตามที่ต้องประสบกับความสูญเสีย เสียค่าใช้จ่าย เสียหาย (ไม่ว่าจะโดยตรงหรือเป็นผลจาก) การบาดเจ็บทางร่างกายหรือค่าใช้จ่ายใดๆ อันเกิดขึ้นจากความล่าช้า ความไม่ถูกต้อง ความผิดพลาด หรือ การขาดตกข้อมูลด้านราคา การส่งออกอากาศ การกระทำใดๆ อันเกิดจากความเชื่อถือ หรือจากความบังเอิญ หรือจากเหตุผลจากการไม่มีประสิทธิภาพ หรือการขัดจังหวะ หรือการยกเลิก

โปรแกรมแนะนำเพื่อนเพื่อรับเครดิตฟรีและโปรแกรมรีวอร์ดของ iamquinn.com รวมถึงผลประโยชน์ ขึ้นอยู่กับดุลยพินิจของบริษัท ยัสปาล จำกัด (มหาชน)เท่านั้น บริษัทฯ ขอสงวนสิทธิ์ในการเปลี่ยนแปลง ยกเลิกบริการที่นำเสนอรวมทั้งคะแนน ทั้งหมดหรือบางส่วน โดยการตัดสินใจแต่เพียงผู้เดียว โดยแจ้งหรือไม่ต้องแจ้งสมาชิกล่วงหน้า บริษัท ยัสปาล จำกัด (มหาชน) อาจทำการเพิกถอน จำกัด เปลี่ยนแปลงเครดิต เพิ่มหรือลดจำนวนเครดิต ตามความจำเป็นสำหรับข้อเสนอพิเศษที่เกี่ยวข้องกับการแนะนำเพื่อนหรือโปรแกรมรีวอร์ดนั้นๆ การสมัครเป็นสมาชิก iamquinn.com ถือว่าคุณได้ยอมรับว่า โปรแกรมการแนะนำเพื่อน และการรับเครดิตคืนของ iamquinn.com ไม่มีหน้าที่รับผิดชอบในการชดใช้ความเสียหายอันเกิดจากการเปลี่ยนแปลงหรือยกเลิกโปรแกรมดังกล่าวได้

1. การชดเชยค่าเสียหาย

ผู้ใช้งานยอมรับว่าจะไม่เรียกร้องและบังคับให้บริษัท ยัสปาล จำกัด (มหาชน) (หรือพนักงาน ผู้บริหาร ผู้ผลิตสินค้า บริษัทย่อย บริษัทร่วมทุน และหุ้นส่วนทางกฎหมาย) รับผิดชอบค่าใช้จ่ายหรือเรียกต้องใดๆ รวมถึงค่าใช้จ่ายของทนายความที่เกิดขึ้นจากและต่อค่าเสียหาย ค่าใช้จ่าย ความเสียหาย และจำนวนเงินที่เกิดจากการละเมิดเงื่อนไขและข้อกำหนดเหล่านี้ หรือการกระทำใดๆ ที่เกี่ยวกับบัญชีสมาชิกผู้ใช้งานเนื่องจากการละเลยหรือการกระทำที่ผิด

1. การใช้งานเว็บไซต์

บริษัท ยัสปาล จำกัด (มหาชน) มิได้รับรอง หรือรับประกันว่าเนื้อหาใดๆที่ปรากฏบนหน้าเว็บไซต์เหมาะกับการนำไปใช้ในแขตกฎหมายอื่นๆ (นอกเหนือจากสหราชอาณาจักรไทย) เมื่อคุณเข้ามาที่เว็บไซต์ เราถือว่าคุณยอมรับและรับประกันต่อบริษัท ยัสปาล จำกัด (มหาชน)ว่า คุณมีสิทธิตามกฎหมายในการทำเช่นนั้นและเพื่อใช้ข้อมูลที่อยู่บนเว็บไซต์ของเรา

1. ทั่วไป

13.1 ข้อตกลงทั้งหมด เงื่อนไขการให้บริการของเว็บไซต์ iamquinn.com ทั้งหมดนี้เป็นข้อตกลงเบ็ดเสร็จและเด็ดขาดระหว่างคุณและบริษัท ยัสปาล จำกัด (มหาชน)ที่เกี่ยวเนื่องจากการที่ท่านเข้ามาใช้งานเว็บไซต์ของเรา ทั้งคุณและ บริษัท ยัสปาล จำกัด (มหาชน) มิได้ถูกผูกมัด หรือแสดงนัยยะถึงรับรองทั้งจากการแสดงให้เห็นหรือเป็นนัยยะ หรือสัญญาใดๆ ที่ไม่ได้บันทึกไว้ในนี้ นอกเสียจากจะมีการกล่าวถึงไว้อย่างเฉพาะเจาะจง ข้อกำหนดและเงื่อนไขในการให้บริการของเว็บไซต์ของเราฉบับนี้ใช้แทนและทำเพื่อแทนที่สัญญา การยอมรับ ความรับผิดชอบในฉบับก่อนหน้านี้ ไม่ว่าจะเป็นทางลายลักษณ์อักษรหรือปากเปล่าก็ตามที คุณมีหน้าที่พิจารณาและตรวจสอบฉบับล่าสุดทุกครั้งที่คุณเข้ามาเยี่ยมชมเว็บไซต์

13.2 การเปลี่ยนแปลงแก้ไข บริษัท ยัสปาล จำกัด (มหาชน) อาจมีการเปลี่ยนแปลง แก้ไขข้อกำหนดและเงื่อนไขเหล่านี้ได้ทุกเวลา เราถือว่าคุณยอมรับข้อกำหนดและเงื่อนไขฉบับล่าสุดเมื่อคุณเข้าเยี่ยมชมเว็บไซต์ของเรา คุณมีภาระผูกพันกับเงื่อนไขและข้อกำหนดที่เกี่ยวข้องฉบับล่าสุด (“ฉบับล่าสุด”) และจะถือว่าฉบับปัจจุบันมาแทนที่ฉบับก่อนหน้า นอกเหนือจากจะมีการระบุไว้ในฉบับปัจจุบัน คุณมีหน้าที่ความรับผิดชอบในการตรวจสอบฉบับปัจจุบันทุกครั้งที่คุณเข้าใช้งานเว็บไซต์

13.3 ความขัดแย้ง กรณีที่มีความขัดแย้งระหว่างกำหนดข้อตกลงและเงื่อนไขของเว็บไซต์ กับเงื่อนไขและข้อกำหนดอื่นๆ ไม่ว่าจะเป็น นโยบายหรือประกาศ หรือเงื่อนไขและข้อตกลง นโยบาย หรือประกาศที่เกี่ยวข้องอื่นๆ ในการที่ผู้ใช้ใช้งานส่วนใดส่วนหนึ่งของเว็บไซต์ จะถือเอาเงื่อนไขและข้อตกลง นโยบาย หรือประกาศที่เกี่ยวข้องในส่วนที่เกี่ยวข้องอย่างในส่วนนั้นอย่างเฉพาะเจาะจงเป็นหลัก

13.4 การสละสิทธิ์ การผ่อนผันหรือยืดเวลาที่คุณหรือบริษัท ยัสปาล จำกัด (มหาชน)ให้ต่อกันนั้น ไม่นับเป็นการสละสิทธิ์หรือเป็นการจำกัดสิทธิ์ในปัจจุบันหรืออนาคตของผู้ให้สิทธิ์ ไม่ว่าจะตามกฎหมายหรือไม่ก็ตาม ยกเว้นแต่เมื่อมีการทำคำสละสิทธิ์ออกมาเป็นลายลักษณ์อักษรชัดเจนและมีการลงนาม ของบุคคลที่มีอำนาจเพียงพอจากฝ่ายที่อนุญาตให้มีการบอกเลิกสิทธิ์

13.5 การถือครองสิทธิ์ บริษัท ยัสปาล จำกัด (มหาชน) มีสิทธิ์ในการยกให้ โอนสิทธิ์ หรือ มอบหมายสิทธิและข้อผูกมัดทั้งหมด จะเป็นในแง่ของเงื่อนไขการให้บริการ นโยบายและประกาศใดๆ ที่เกี่ยวข้องให้ตัวแทนหรือบุคคลที่สามใดๆ ก็ได้
